Update: Election Code Application

On October 18, 2017, a group of five off-reserve Abegweit Band members filed an Application in the Federal Court of Canada challenging the constitutionality of certain sections of the Abegweit Band Election Code.


Specifically, the Applicants have asserted that the sections of the Abegweit Band Election Code requiring a Band member to be resident on the Reserve to either vote in Band elections or run for the office of Chief or Councilor are contrary to the equality provisions of the Canadian Charter of Rights and Freedoms.


Chief Brian Francis and Councilors Jadis and Knockwood, with the assistance of legal counsel, have been engaged in ongoing discussions with the Applicants and their legal counsel to try and come to an agreeable resolution which saves the cost and uncertainty of having the Court decide the issues.  Any agreed upon resolution will be subject to the approval of Band members through a plebiscite held under the provisions of the Abegweit Band Election Code.  Because the matter is before the Courts, the content of the current discussions must remain confidential.
